U.S. Patents

​Necessary items:
  1. Brief written description of your invention (i.e., electrical circuit, mechanical, chemical formula, etc.)
  2. At least one drawing
  3. Protection desired (i.e., utility patent, design patent)​
Utility Patents have a government filing fee of $664 (small entity), $364 (micro entity), with a 20 year life, and cover both function and appearance. Inventions include mechanical devices, electronics, chemical compositions, recipes/formulas and software. Design Patents cover appearance only protection with a government fee of $408 (small entity), $204 (micro entity). Provisional applications are not patents, but do allow one to use the patent pending status for a government fee of $120 (small entity), $60 (micro entity). Non-refundable attorney fees are in addition to the government fees based on the project and complexity. Provisional applications must be converted into a utility application within one year to obtain a patent. ​

U.S. Trademarks

Necessary items:
  1. Owner name (company or individual)
  2. Name, logo, as it is currently used or as it is planned to be used
  3. A description of use

​​U.S. Federal trademarks have a $350 government filing fee per class of goods/services (clothing, paper goods, etc). Non-refundable attorney fees are in addition to the government fees based on the project and complexity. Other legal and government fees are assessed during the prosecution and maintenance process which add extra costs. Renewals are at 5 and 10 year intervals.

U.S. Copyrights

Necessary items:
  1. Name of author/creator
  2. ​Type of material to be copyrighted (i.e., book, painting, website)

Government filing fees are $65-$85 depending on the type of work to be copyrighted.  Non-refundable attorney fees are in addition to the government fees based on the project and complexity.

Licensing

​Necessary item:
  1. Copy of property subject to license (ie: patent, trademark, copyright, etc.)

Related Litigation

Necessary item(s):
  1. Copy of cease and desist letter and/or,
  2. Court complaint and/or,
  3. Litigation subject matter (i.e., patent, product brochure)
